Dan Jarcho

I am a federal court litigator focusing on complex cases involving federal regulatory issues. I represent clients in Administrative Procedure Act challenges to federal agency regulations, policies and procedures. I also defend clients facing federal regulatory enforcement actions. Many of my matters concern disputes with the U.S. Food and Drug Administration. I have more than 25 years of experience handling FDA litigation (including a number of years at the Department of Justice office that represents FDA in its federal court litigation). I also have litigated cases with numerous other federal agencies (including the Defense, Agriculture, Treasury and Interior Departments and U.S. Customs and Border Protection). I have litigated cases in the U.S. District Courts, the U.S. Courts of Appeals, and the Supreme Court. My FDA enforcement work includes defending FDA civil actions for seizures, injunctions and civil penalties and FDA criminal investigations. I also counsel clients on resolving FDA compliance disputes that could lead to litigation, including conflicts over inspections, Form 483 observations, Warning Letters, recalls and import alerts. My community work includes serving as President of the Legal Aid Society of the District of Columbia, which is Washington, D.C.’s largest general civil legal services program for clients living in poverty.
