Regularly counsel employers on issues pertaining to wage disputes, hiring and firing, employee handbooks, wrongful termination, confidentiality, and non-compete contracts, unemployment benefits, Title VII concerns and compliance, FMLA compliance, ADA and CADA claims, FLSA overtime requirements and exemptions and retaliation issues. Regularly counsel clients on cost-benefit analysis and company policy issues in relation to employee disciplinary decisions. Represents employers in investigation proceedings before the Equal Employment Opportunity Commission, Colorado Civil Rights Division, United States Department of Labor, Colorado Department of Labor and the Colorado Industrial Claims Appeals Office. Drafts employment agreements, dealership and distributor agreements, vendor agreements, service agreements, warranty agreements, as well as general sales contracts. Additionally counsels and defends businesses in a variety of commercial disputes including contract disputes, franchise disputes, dealership disputes, vendor disputes, ownership disputes, trademark claims, D&O liability, product liability defense, and real estate matters.
