Advising clients on various aspects of protection and enforcement of Intellectual Property Rights (IPR). Primarily, managing IP portfolio of several clients in diverse fields like pharmaceuticals, tobacco, automobiles, retails, real estate, textiles and garments, FMCGs, finance and stock marketing including multinational companies. For instance: • National and International registrations and prosecutions of various IPR • IP litigations comprising of infringement and passing off issues, issues relating to trade dress infringement, personality right encroachment and comparative advertising; anti-suit injunction proceeding which include strategizing, drafting of pleadings, briefing counsels and appearing in courts. • Advising on various IPR issues including common law related aspects of IPR such as confidentiality, tort of passing-off, trade secrets and goodwill; opinion on registrability of the trade marks, search opinions, conception of trade marks; caution notices; IPR audits; initiating criminal actions on IPR infringement and hacking issues. • IP perspective of commercial transactions including strategizing, documentation, negotiations pertaining, inter alia, to technology transfers; licensing, franchising and acquisition of IP; assignment; co-existence; co-branding; confidentiality and employee agreements; IPR aspects pertaining to mergers and acquisitions (M & A), joint ventures; OSS issues, due diligences in IPR related transactions and audit of IP portfolios for clients in sectors, inter alia, relating to FMCG, retail, real estate, automobile and pharmaceuticals. • Domain dispute cases at WIPO, INDRP/NIXI, NOMINET and DENIC. • Opining on various International Treaties relating to Intellectual Property Law and their effect on the Indian Intellectual Property Law. • Advising on Copyright infringement issues particularly on royalty sharing and licensing issues.
